Adding Form IT-204-LL

You can add Form IT-204-LL to a partnership return by marking the
Filing fee
box. Select
File
, then
Client Properties
, followed by the
New York
tab.
An LLC/LLP doesn't need to file Form IT-204-LL if they don't owe a fee. Enter
X
in the
Entity did not have any income, gain, loss, or deduction from NYS during the tax year
field on the NYGen screen in the New york General input folder to suppress the fee from calculating on Form IT-204-LL.

Filing deadline

If a fee isn't owed, Form IT-204-LL doesn't have to be filed. If it is owed, then it's due on March 15th for calendar year taxpayers and there is no extension of time to file. If you file the return after the due date it's subject to penalties and interest for late filing, which New York will assess. You can find the total penalty and interest on the bottom of Form IT-204-LL.
The filing instructions also list the total of both the line 5 filing fee due plus the total penalty and interest. You are expected to pay this amount with the return via electronic funds withdrawal (EFW).

Filing state and federal returns

To suppress printing or e-filing Form IT-204-LL:
  1. Go to the NY input, to the LLC/LLP folder.
  2. Use either the
    Suppress partnership IT-204-LL electronic file only
    or
    Suppress all units of IT-204-LL electronic files
    fields. Don't remove this return under
    Client Properties
    . If you do, the return will not proforma.
To print and e-file only Form IT-204-LL and suppress the federal return:
  1. Go to the Federal Electronic Filing input folder
  2. Open the ELF screen
  3. Mark the
    Suppress the creation of: Federal ptrshp electronic files when only filing the FinCEN114 or a state return or extension electronically
    field to prevent the Federal return from printing.
  4. Go the NY Electronic Filing input folder
  5. Open the ELF screen
  6. Mark the
    Suppress New York partnership return electronic file when filing federal return electronically
    field.
