Which report year do I file if I have a fiscal year-end return?
Answer
The Texas Franchise tax is based upon the results of operations ending in the year preceding the report year. The report year equals the year filed.
Texas Franchise tax privilege periods, other than initial reports and final reports, are defined as having a January 1 to December 31 calendar year, even if the federal return is for a fiscal year.
For the annual report period, the accounting year end date is the end date for federal income tax purposes in the year before the annual report is originally due. Texas annual reports for a fiscal year federal return will initially be due on May 15 of the calendar year following the federal return year end date.
