Skill: Identify mischaracterizations

Category: Research

The
Identifying Mischaracterizations
skill is designed to help you find potential mischaracterizations of case quotes within the context of briefs or other filings - whether yours or your opponent's, using trusted Westlaw research.

Features and benefits

  • This skill accelerates legal analysis by quickly locating and identifying potentially inaccurate quotations that feature common errors such as selective quotation, misquotation, or improper citation. Such errors can be caused by omission of important context, facts, citations, or clauses.
  • Use this skill to check your own work or to identify weaknesses in an opponent's work.

Practice tips

  1. Upload a brief or other document (yours or your opponent's) containing case quotes and citations.
  2. Select the type of analysis you want CoCounsel to do - that is, whether you want it to check your work or to analyze an opponent's work.
  3. The skill will output a list of potential mischaracterizations with detailed descriptions of quotation errors and side-by-side comparisons of each quotation from the document and corresponding quotation from the cited source.
  4. Outputs contain links to cited sources on Westlaw.

Limitations to keep in mind

  • CoCounsel needs quotations and citations to analyze. If you don't upload documents that include case quotes and citations, you will receive the following response: “The uploaded document has 0 potential mischaracterizations.”
  • Individual file size is generally capped at:
    • 20MB per file for TXT, HTM, HTML, or RTF files
    • 500MB for PDF, DOC, DOCX, EML, MSG, WPD, and ZIP files
  • The skill requires a Westlaw subscription in addition to a CoCounsel subscription but is available to subscribed users in the CoCounsel user interface.
