Workflow: Respond to discovery requests

Category: Draft

The
Respond to Discovery Requests
workflow is designed to reduce the time it takes an attorney to draft tailored written responses to discovery requests.

Features and benefits

  • Use
    Respond to Discovery Requests
to upload the request document by itself, or add pleadings like a Complaint and Answer or other reference documents.
  • You can also instruct the workflow to produce a specific tone or style. The workflow is designed to use the uploaded information to craft tailored discovery responses.

Practice tips

  1. Clearly describe how you want the responses or objections to be drafted, including any specific instructions or preferences for drafting the responses, for example, tone, style, or particular objections to raise.
  2. Upload the document containing the discovery requests.
  3. Optional: Upload any reference documents such as the Complaint, the Answer, pre-discovery motions, and any other supporting documentation containing information responsive to the requests (for example, emails, contracts, medical files, invoices). Without any reference documents, the workflow will add placeholders for information relevant to a complete response.
  4. The workflow will produce a discovery response document that is formatted to align with the requirements of the specified court. The output will include all the expected sections of a discovery response including general objections, verbatim copies of each request from the original request document, and responses to each request with both an objection and a substantive response. The user will then be able to open the drafted response in MS Word and further modify each response according to their preferred strategy.
note
The output will be enhanced by the quality of your instructions, meaning the more information and context/background you provide regarding any specific language or points you want to address, the better the result.

Limitations to keep in mind

  • The
    Respond to Discovery Requests
workflow requires at least 1 document to be uploaded into the workflow before processing.
  • The workflow requires that the discovery request be the only document in the 1st upload field of the workflow window.
  • Keep in mind that the output won’t be a final version of a set of discovery responses ready for filing but will instead be equivalent to what a junior associate would produce as a 1st draft, completed in a fraction of the time.
  • Individual file size is generally capped at:
    • 20MB per file for TXT, HTM, HTML, or RTF files
    • 500MB for PDF, DOC, DOCX, EML, MSG, WPD, and ZIP files
  • The workflow requires Westlaw and Practical Law subscriptions in addition to a CoCounsel subscription but is available to subscribed users in the CoCounsel user interface.
