Form 05-102, Public Information Report print requirements

Review the settings and entity information required to print Texas Form 05-102, including manual entry and paper-filing instructions.
Taxpayers should file Texas Form 05-102, Public Information Report when the entity's annualized total revenue is under the non tax due threshold: $2,470,000 for 2024. To Print the Texas Form 05-102, Public Information Report, check the following:
  1. Verify the entity doesn't have
    Severe
    diagnostics for Texas:
    1. Select
      View
      , then
      Diagnostics
      . Texas mandates the state can't print any forms when severe diagnostics are present. Clear them for Texas.
  2. Go to
    Organizer
    States
    Common State
    .
  3. Go to
    General Information
    Basic Return Information
    Return Information
    tab.
  4. Make sure the
    Column G, Final Return
    field is clear for Texas.
  5. Go to
    Organizer
    States
    Common State
    .
  6. Select
    Print Options
    , then
    Print Suppression
    .
  7. Go to the
    Suppression SC-Cities
    tab.
  8. Make sure
    Texas
    is cleared in the
    State Forms
    column.
  9. Go to
    Organizer
    States
    Texas
    General Information
    .
  10. In the
    General Information
    section, enter the
    Taxpayer Number
    .
  11. Select
    YES
    for
    Corporation, limited liability company, professional association, limited partnership, or financial institution
    ,
  12. Verify that the
    This entity does not have NEXUS in Texas
    field is cleared.
  13. Verify that
    This entity is a disregarded entity
    is cleared.
  14. In the
    No Tax Due Report
    section, verify the
    Passive entity as defined in Chapter 171 of the Texas Tax Code
    field is cleared.
  15. Go to the
    Payment of Tax During Preceding Tax Year (Mandatory)
    section and make a selection other than
    Blank
    .
  16. Select
    Return Options
    , then
    Print Suppression
    .
  17. Make sure
    Form 05-102
    is cleared.

Manually entering multiple 05-102 forms

You can manually add The Public Information Report (05-102) and the Owner Information Report (05-167) within a
Single
entity type return.
  1. In Organizer, select
    States
    , then
    Texas
    .
  2. Go to
    Information Report - Manual Entry
    Public Information Report
    Add New Taxpayer Name
    .
    • This lets you make manual entries for the report.
    • A version of the report prints and e-files with the manually entered information.
  3. In Organizer, go to
    States
    Texas
    Return Options
    .
  4. Go to the
    Print Suppression
    section and make sure the
    Manual Entry Form 05-102
    field is cleared.

Printing instructions for Form 05-102

When filing electronically, there are no separate filing instructions for Form 05-102 because it must be included with the Texas e-file submission.
When filing on paper, however, Form 05-102 can be filed separately, and separate filing instructions are available in this case.
To print instructions for paper-filing Form 05-102:
  1. Go to
    Organizer
    States
    State E-file
    Enable/Create
    .
  2. Go to the
    Return
    tab.
  3. Clear the
    Enable e-file
    checkbox for the Texas return.

Section A print requirements

Officer names may not appear in Section A of Texas Form 05-102, Public Information Report, if officers aren't enabled for Texas or if return options aren't configured correctly.
Solution 1: Turn on officer for Texas
  1. Go to
    Organizer
    Income and Deductions
    Deductions
    Officers Compensation
    Individual Officers
    [officer name]
    .
  2. Select
    Federal and Selected State
    , then select
    Select States
    .
  3. Check the
    TX
    checkbox so the officer populates Form 05-102, Section A.
  4. Reconsolidate the TopCon and refresh the print.
Solution 2: Configure return options
  1. Go to
    Organizer
    State Franchise Tax
    Texas Franchise
    Return Options
    .
  2. Select the
    Officer information entered in target return
    checkbox.
  3. Run a full recompute and refresh the print.
Solution 3: Enter NONE for stock ownership
  1. Go to
    Organizer
    Income and Deductions
    Deductions
    Officers Compensation
    Individual Officers
    [officer name]
    .
  2. In the
    Compensation of Officers - General Information
    section, enter
    NONE
    for
    Percent of common stock owned
    and
    Percent of preferred stock owned
    .
Solution 4: Verify officer and entity settings
For officers to print correctly on Form 05-102, verify these settings:
  1. Officers are entered in both
    Organizer
    Income and Deductions
    Deductions
    Officers Compensation
    Individual Officers
    and
    Organizer
    State Franchise Tax
    Texas Franchise
    Information Report
    Public Information Report
    Officers, Directors or Members
    .
  2. Entity is designated as a corporation or LLC in
    Organizer
    State Franchise Tax
    Texas Franchise
    General Information
    General Information - Corporation, Limited Liability Company
    (select
    Yes
    ).
  3. In
    Organizer
    States
    Common State
    General Information
    Basic Return Information
    Return Information tab
    , Column H Final Return TX checkbox is not checked.
  4. In
    Organizer
    State Franchise Tax
    Texas Franchise
    Combined Return Information
    Affiliate Detail
    , there is an X in the PIR required column for any entity that should generate Form 05-102.
  5. The
    Print Information available in Taxpayer's Office
    checkbox under
    Organizer
    Income and Deductions
    Deductions
    Officer's Compensation
    Summary of Officers Comp
    is cleared.

For consolidated returns, enter officers at the member (subsidiary) level, not at the TopCon level.

Section A officer details on Texas Form 05-102 Public information report don't print when a specific checkbox is selected in the General information settings.

Solution 1
Section A of Texas Form 05-102 doesn't print or officer details are missing from the printed output for 1120 returns.
  1. Go to
    Organizer
    State Franchise Tax
    Texas Franchise
    Information Report
    Public Information Report
    General Information
    .
  2. Clear
    There are currently no changes from previous year
    .
  3. If needed, select
    Delete Trapped Officer Data Form 05-102 Section A
    .
  4. Recompute the return and refresh the print.

When
There are currently no changes from previous year
is checked, Form 05-102 Section A won't print. This setting suppresses the officer details section because no changes need to be reported.
Solution 2
If officer information entered at the parent entity isn't printing on Form 05-102 Section A for consolidated returns:
  1. Go to
    Organizer
    Income and Deductions
    Deductions
    Officers Compensation
    Individual Officers
    [Officer Name]
    .
  2. In
    Time devoted to business
    , enter
    1
    for 100%.
  3. Recompute the return and refresh the print.

Correct the due date on Texas Form 05-10

If the due date displays incorrectly on Texas Form 05-102, update the Extended Due Date using one of the following methods.
Use the following Method 1 (Tax Forms) or Method 2 (Organizer).

    2. Enter the correct date in the
      Extended Due Date
      field.
    3. Perform a full recompute to update the form.

    2. Enter the date in
      Column O
      .
    3. Perform a full recompute to update the form.

If you're not filing an extended Texas return, the Original Due Date is computed automatically based on the Calendar or Fiscal Year Ending date, per Texas instructions.

Section A not populating officer information

Section A of Texas Form 05-102, Public Information Report isn't populating with officer information. This typically occurs when officer data isn't properly configured for Texas or when consolidated return settings need adjustment.
Complete these steps at each lower member of your consolidated return:
  1. Go to
    Organizer
    Income and Deductions
    Deductions
    Officers Compensation
    Individual Officers
    and add a new officer.
  2. Select the officer name, then select
    Federal and Selected State
    and
    Select States
    . Mark the
    TX
    checkbox so the officer populates TX Form 05-102, Section A.
  3. Make sure the same officer details are flowing to
    Organizer
    State Franchise Tax
    Texas Franchise
    Information Report
    Public Information Report
    Officers, Directors or Members
    .
  4. Go to
    Organizer
    State Franchise Tax
    Texas Franchise
    Return Options
    and verify the
    Officer information entered in target return
    checkbox is clear.
  5. Go to
    Organizer

    , and find the selection for

  6. Go to
