Min/Max

On some occasions, the Customs Authority may decide to set Minimum and/or Maximum values for a tax rate to be paid. Being aware of these instances is crucial for ensuring compliance and facilitating smooth commercial operations.

When available, these Minimum and Maximum values are shown in the Min/Max column. They establish a range that the calculated duty rate must fall within. This means that after the duty calculation is performed, the rate should align with the range specified by the Customs Authority. If the calculated rate falls outside this range, the Minimum or Maximum rate will be applied by default, depending on the situation.

In the given example, the Main Duty has a Minimum value of 0.0474 CAD per kilogram and a Maximum value of 0.0948 CAD per kilogram. If the calculated rate falls below the Minimum value, then the rate of 0.0474 CAD per kilogram will be applied. Conversely, if the calculated rate exceeds the Maximum value, the rate of 0.0948 CAD per kilogram will be applied. If the calculated rate falls within the specified range, there will be no further adjustments to the rate.

There may be instances where only a Min or Max value is set by the Customs Authority. The principle of application remains the same. For instance, if a Minimum Value of 0.308 CAD per unit is established and the calculated duty rate falls below this threshold, then the Minimum Value of 0.308 CAD per unit will be applied as the final duty rate.Min/Max values can also be applied to specific preferential duty rates under certain agreements. The application of these values follows the same criteria as previously described. For example, if an agreement specifies a Minimum value, the calculated duty rate must meet or exceed this minimum. If it does not, the Minimum value will be applied as the duty rate.Please note that the Min/Max values always reflect the rates in effect at the time of calculation.
