FTZ Management: Frequently Asked Questions (FAQ) on Reports and Lacey Act Declaration Requirements

  1. Where can I get the official information regarding the Aluminum Smelt and Cast Requirements?
  2. How do I know if I need to file the additional data elements?
    CSMS 55438432 lists the HTS that are impacted and need the additional information.
  3. My menu changed and I am seeing an Aluminum menu option. Why is that?
    • ABI – In the past year, you filed an entry that had one or more of the potential HTS listed by CBP, so we automatically added the new menu option to your menu.
    • FTZ – You have inventory of one or more of the potential HTS listed by CBP, so we automatically added the new menu option(s) to your menu.
  4. What do these new Aluminum menu options do?
    • ABI-01 Self-Filer – If you fill out the new data elements in the Menu, the data will automatically be transmitted to CBP when you transmit your Entry Summary.
    • FTZ Self-Filer – If you fill out the new data elements in the Menu, the data will automatically be transmitted to CBP when you transmit your 7501.
    • FTZ Broker Filer -
      • Standard 7501 ACE CATAIR Interface to your broker – If you fill out the new data elements in the Menu, the data will automatically be transmitted to your broker when you transmit your 7501. If your broker is not ready to accept this new data in the feed yet, simply do not fill out the new data fields in the menu option and your file will not change. You will, however, need your broker to transmit the new data to CBP for you. Please communicate with your broker to see what they would like you to do.
      • Custom/Non-Standard 7501 Interface to your broker – Your interface will not be automatically updated with the new fields, because your broker will need to communicate how they would like to receive the new data in the file. This will need to be an SOW to make the non-standard update and test the new format between ONESOURCE and your broker. If you fill out the new data elements in the Menu, the data will not automatically be transmitted to your broker until this happens. You will need to work with your broker to have them transmit the new data to CBP for you, until the SOW to update your Custom/Non-Standard 7501 Interface is complete.
  5. What is the data that is found in the new Aluminum menu options?
    • ABI: These are parts with potential HTS numbers on any entry summary in New, Hold or Revalidate status.
    • FTZ: These are parts with potential HTS numbers on any un-generated (unprinted) 7501.
    • Aluminum – NPF and PF Components
      • For non-zone manufactured parts or PF components of manufactured parts.
    • Aluminum – NPF Manufactured FG
      • For zone manufactured Finished Good parts where the Finished Good is classified with the impacted HTS and have NPF components under it with the impacted HTS. The FG HTS is what is reported, but we will show you all the NPF/PF components under it with the impacted HTS to help you research what you need to report.

  7. I need to file the new Aluminum data entry requirements, but I do not have a menu option to do so. How can I file?
    Request your customer support team to add the new menu option to your menu. You will need to know if you are filing FTZ entries or a self-filer of other entry types.
    • If you are self-filing entries other than an 06 entry type, request the ABI/Aluminum Smelt and Cast menu.
    • If you are an FTZ filer and you are not doing any manufacturing, request the FTZ/Aluminum – NPF and PF Components menu.
    • If you are an FTZ filer and you are manufacturing, request both below options:
    FTZ/Aluminum – NPF Manufactured FG menu.
    FTZ/Aluminum – NPF and PF Components menu.
  8. I am seeing parts on an entry in my new menu option that I do not need to provide data to US Customs, why is it showing in the menu?
    These are new requirements initiated by the US Government. CBP provided very broad guidance on what needs to be filed and there are many open questions out with CBP on the details of the requirements. Until we know more about these requirements, we provided every potential possibility given by CBP on if something could be filed. Just because an item is listed in the menu, doesn’t mean you are required to report the new data elements.
    You know your products best and will have the best knowledge on if you should file. We did not want to limit or hinder your filing ability, so simply fill out the information on the ones you know you need to file and leave the others blank if you know you do NOT need to file. We will not stop you from filing without the data or force you to file any of the new data elements at this time. In the future as we learn more about these requirements, we will narrow the scope and provide validations around verified requirements.

  10. Why did you not validate my Entry Summary/7501 to tell me I was missing the Aluminum Smelt and Cast information before CBP rejected the entry?
    These are new requirements initiated by the US Government. CBP provided very broad guidance on what needs to be filed and there are many open questions out with CBP on the details of the requirements. Until we know more about these requirements, we did not want to force you to file any information and potentially hold up your ability to file. In the future as we learn more about these requirements, we will provide validations around verified requirements.
  11. I need to fill out/correct data for an Entry Summary/7501 but my entry is not listed in my menu. What do I do?
    • If it is an ABI-01 Entry Summary, the entry must be in New, Hold or Revalidate status. Simply go to your entry summary and re-save it to put it into a Revalidate status.
    • If it is an FTZ 7501, the entry must be unprinted. Simply go to your 7501 and unprint the 7501.
  12. I filled out the new menu items, but I still got rejections from CBP because I was missing the Aluminum Smelt/Cast requirements. Why is that?
    • If you are a self-filer, they should have automatically transmitted to CBP. Please ensure that the lines that are rejecting were filled out correctly. If they were, please contact support for assistance.
    • If you are a broker filer:
      • If you are using a non-standard, custom broker interface, and have not completed an SOW to have the interface updated with your broker, the data will not automatically transmit to your broker.
      • If you are using the TR standard ACE CATAIR broker interface, the data will automatically transmit to your broker if you filled out the new menu. Please check with your broker to see if they updated their process to receive the new CATAIR interface changes.
  13. Why do I need to fill out the information at the time of the 7501 filing instead of when I receive the goods into my FTZ?
    CBP initiated these requirements in a very short window of time. As a phase I to meet the go-live filing date, we provided functionality at the time of Entry Summary/7501 filing. As a phase II, in the future, we will provide new functionality that will allow you to capture the information at the time of receipt. It will then follow your product through the FTZ life cycle on your Entry Summary/7501 filing. We will provide you with information on when that new functionality will be available.
  14. I am an FTZ filer that files through a broker using a non-standard, custom broker interface. Why am I being told I need an SOW to update my interface when this is a government required change?
    If you are utilizing a non-standard, custom broker interface to send data to your broker, the specifications for that interface belong to your broker. We developed that interface according to your broker’s specifications and we are unable to alter that format without updated specifications from your broker. Once the changes are made, you will need to test that the updated interface works properly with your broker. An SOW is required for the testing environment and an implementation team to support the update.

Lacey Act Declaration Requirements for Foreign Trade Zones

  • If I am an FTZ, how do I file LACEY requirements in ACE?
    • LACEY is reported on the Entry Summary (7501) in ACE. This reporting on the Entry Summary for FTZ’s can be done one of two ways:
      • Full PGA Message Set - You can file the full Lacey PGA message set on the 7501. However, if you choose this method, you will have to provide the PGA message information for the exact physical item that is leaving the zone at the time of the 7501 itself. Most FTZ’s utilize the First In First Out (FIFO) method of reporting on the 7501. Most FTZs have a hard time knowing the exact, fungible item leaving the zone to be able to tell the FTZ software. This reporting method wasn’t feasible for most FTZ’s, so Lacey worked with the NAFTZ and provided FTZs an interim solution until PGA is added to the e214 in ACE.
      • Interim Solution for FTZs – Until the PGA message set is added to the e214, FTZs can utilize the Lacey Act Web Governance System (LAWGS) at the time you file your e214. Then when you file your 7501, you can select a mass disclaim for each required HTS that indicates you filed your Lacey declarations in LAWGS.
  • How do I indicate on a receipt in ONESOURCE Global Trade FTZ, LAWGS was filed?
    • o If you are an FTZ, you will not be reporting anything in the ONESOURCE Global Trade FTZ software on the 214 itself. Lacey is currently operating under an interim process for FTZs until CBP adds the PGA message set to the e214. PGA/e214 functionality is not available with CBP at this time in ACE. Warnings can be turned on in the ONESOURCE Global Trade FTZ software if you wish to know of any items going onto the daily 214 that flag for Lacey. This would alert you that you may need to file a LAWGS for goods about to be admitted into the FTZ.
  • Can I file the Lacey Act Declaration in LAWGs through ONESOURCE Global Trade FTZ software or does that have to be a separate step outside of the FTZ software?
    • It is a separate step outside of the ONESOURCE Global Trade FTZ software.
  • If I am an FTZ and file Lacey using LAWGS, how do I report on the 7501?
    • If an item is filed in LAWGS, then only a Disclaim is needed on the 7501 Entry Summary. ONESOURCE Global Trade FTZ software has a mass disclaim functionality that can be utilized on each 7501 Entry Summary. You will elect how you wish to Disclaim the products on that particular entry. It is all or nothing though, so you must ensure that if you have items on the Entry Summary that flag for Lacey and you disclaim, you have really done your due diligence in LAWGS. This is where the mass disclaim of Lacey on the 7501 occurs:
    • If you click the Disclaim Lacey link, a pop-up will appear, and you can choose which disclaim you want to provide for the items flagged as either AL1 or AL2:
    • If you are a Self-Filer, then the disclaims will automatically transmit to ACE on your 7501.
    • If you are filing with a broker and you want the disclaims to be transmitted in the file, you will need to ensure that the disclaims are part of your feed to your broker. If not, your broker interface would need to be updated and that would be an SOW project.
  • If I am an FTZ filing everything through LAWGs, do I need to populate Global Classification/PGA with Lacey information in order to file on my 7501?
    • If you are going to disclaim the goods on the 7501 entry summary because you utilized LAWGS, there is no PGA data to transmit on the 7501 except the disclaims. Nothing in the Global Classification/PGA module would populate the FTZ 7501 Entry Summary in your zone.
