China: The final ruling on the anti-dumping investigation of imported polycarbonate originating from Taiwan

On April 19, 2024, The Ministry of Commerce of the People's Republic of China (MOFCOM) issued Announcement No. 13 of 2024, which details the final ruling on the anti-dumping investigation of imported polycarbonate from Taiwan. The investigation, which began with Announcement No. 35 of 2022 on November 30, 2022, concluded that there was dumping of polycarbonate from Taiwan that caused substantial damage to the mainland Chinese polycarbonate industry, with a causal relationship between the dumping and the damage. Taiwan is the largest source of polycarbonate imports in China. In 2022, the polycarbonate imported by China from Taiwan accounted for about 23.48%, a quarter of its import market.
As a result, starting from April 20, 2024, anti-dumping duties will be imposed on the investigated products for a period of five years. The anti-dumping duty rates vary by company, with Taiwan Chemical Fiber Co., Ltd. and Taiwan Idemitsu Petrochemical Co., Ltd. both facing a 9.0% duty, Chi Mei Industrial Co., Ltd. and Qiling Technology Co., Ltd. at 12.2%, and all other Taiwanese companies at 22.4%.

  • Products under this tariff number with a bisphenol A polycarbonate content of less than 99% by weight are not within the scope of the products under investigation.
The anti-dumping duties will be calculated ad valorem based on the customs-approved duty-paid price, and value-added tax will be levied on the sum of the duty-paid price, customs duties, and anti-dumping duties.
The ruling also specifies that for imports made between August 15, 2023, and December 14, 2023, deposits provided will be recalculated according to the final ruling, with any excess refunded. Imports made from December 15, 2023, to April 19, 2024, will have their deposits refunded, and no retroactive anti-dumping duties will be levied on imports before August 15, 2023.
New exporters from Taiwan can request a review, and interested parties can apply for an interim review during the imposition period. Those dissatisfied with the decision can seek administrative reconsideration or file a lawsuit. The announcement is effective from April 20, 2024.
