China implements new export controls on antimony and superhard materials

On August 15, 2024, China's Ministry of Commerce issued Announcement No. 33, detailing new export controls on antimony-related items and superhard materials. The measures, set to take effect on September 15, 2024, aim to safeguard national security, protect national interests, and fulfil international non-proliferation obligations.

The announcement also includes controls on certain technologies related to antimony smelting and separation, as well as the synthesis and manufacturing processes for artificial diamond and cubic boron nitride single crystals using six-sided top presses.

Export licensing procedure

Exporters need to fulfil the following requirements to obtain the export license.

MOC Examination
If approved, Ministry of Commerce issues an export license for dual-use items and technologies.

Customs Formalities
Exporter presents export license to customs and goes through customs formalities. Customs conducts inspection and release procedures based on the export license.

Penalties for Non-Compliance
Impose administrative penalties for exporting without permission, exporting beyond the scope of the license, or other illegal circumstances. Pursue criminal responsibility if a crime is constituted.
