China expands export controls on rare earths, battery materials, and related technologies

Overview

China has expanded its export control regime to cover a broader scope of strategic materials and technologies. The latest measures target:
  • Lithium battery and graphite anode materials
  • Rare earth-containing products and technologies
  • Technical know-how related to rare earth processing
These controls aim to enhance national security, prevent proliferation, and assert regulatory oversight across global supply chains.

Key measures

1. Lithium battery and graphite materials (
announcement No. 58
)
Effective date: November 8, 2025.
Newly controlled items include:
  • High-energy lithium-ion batteries
    (≥ 300 Wh/kg)
  • Cathode materials
    : LFP, NCM precursors
  • Graphite anode materials
    : artificial, hybrid types
  • Production equipment
    for battery and graphite materials
Exporters are required to acquire export licenses from the China MOFCOM prior to exports.
2. Rare earth-containing items (
announcement No. 61
)
Effective date: October 9, 2025; With specific rules phased in December 1, 2025.
Export License is required:
  • Products manufactured overseas containing
    ≥ 0.1% Chinese-origin rare earths
    by value per usable unit
  • Products made using Chinese rare earth technologies, specifically mining, refining, smelting, magnet production, and recycling technologies
  • Re-exports of controlled items to third countries
Licensing will be DENIED for the purposes below:
  • Entities on the
    export control list
    or
    watch list
    (including subsidiaries with ≥ 50% control).
  • Weapons of mass destruction or delivery systems.
  • Terrorist activities.
  • Military enhancement.
Case by case approval for:
  • Advanced semiconductor R&D
    (logic chips ≤ 14nm, memory chips ≥ 256 layers).
Humanitarian exports are exempt but must be reported post-shipment.
3. Rare earth technologies (announcement No. 62)
Effective date: October 9, 2025.
Export licenses are required for:
  • Technologies related to
    mining, smelting, separation, and magnet production
  • Technical services such as
    assembly, commissioning, maintenance, and upgrades
  • Any form of transfer or provision
    of those items to
    foreign individuals or organizations
    , whether inside or outside China
