Explain the spousal abuse or domestic violence situation, when it began, how it affected the innocent spouse and their family, and how the abuse affected the ability of the innocent spouse to question the items reported on or the payment due on the tax return. Attach required documentation (i.e. police reports, etc.), per the Form 8857 instructions.

Refund and Additional Information

Use this section to enter information to complete the questions in Form 8857, Parts VI and VII.

The IRS will refund only payments the innocent spouse already paid with their own money. Attach the statements of proof to the form. Proof is not required if the IRS used the individual refund to pay a tax owed on a joint tax return for a different year.
