Other Return Options > Consent tab (709)

Use this tab to enter information to prepare the consent to disclosure and/or the use of tax return information globally with all 709 tax returns. When using this option, you do not have to open every client to enter consent information. Use the Document Editing window to create and modify all client documents including consent letters, transmittal letters, filing instructions, and invoices.
To view this tab, go to Setup, 709 Gift Tax, then the Federal tab, Other Return Options, and then select the Consent tab.

IRC section 7216 requires preparers to receive consent from their clients to disclose or use their tax information for purposes other than preparing their tax return and, in certain limited situations, for purposes involving tax return preparation.
We can't provide tax preparers with legal advice on these provisions. You'll have to seek counsel from your own legal advisor as to the specific consequences to, and requirements for, tax preparers regarding IRC section 7216 and the regulations. This would include seeking counsel prior to using any data mining for anything other than the preparation of tax returns, to ensure you are in compliance with all laws and regulations.

  • Depending on your security configuration, you might be prompted to enter the master password before you can open any entity type's tab.
  • If consent information has also been entered on the Consent screen in the General folder for a client, the Consent screen data entry will supersede information entered in this tab.
  • In order to print the consent letter, you'll need to enter the information in the
    Recipients(s) of tax return information
    box or
    Specific uses of tax return information
    box.

Consent to Disclose group box

Enter information in this section to prepare the Consent to Disclose Tax Information.
Print Consent to Disclose
Mark this box to create a Consent to Disclose and have it print with the tax return. If this box is not marked, consent to disclose information will not print with 709 tax returns unless entered on the Consent screen in the General folder. This option is not available by default.
Date consent will expire...
Enter the date the consent will expire. All consents will include an expiration date of "One year from signature date" if no expiration date is specified.
Recipient(s) of tax return information
Indicate up to four specified recipients of the taxpayer's tax information. An option to affirmatively select each recipient prints on the consent form.
Specific uses of tax return information
Indicate up to four specific uses of the taxpayer's tax information. An option to affirmatively select each use prints on the consent letter.
