Form 8858, Information Return of U.S. Persons With Respect to Foreign Disregarded Entities (FDEs) and Foreign Branches (FBs)

In addition to foreign disregarded entities (FDEs), Form 8858 filing has been expanded to include foreign branches (FBs) for tax years 2018 and later. The system automates the preparation of Form 8858 for both foreign and foreign tax credit (FTC) divisions.

You can enter filer information in the 8858 Organizer or go to

During TAS Compute and Consolidation, the default filer information gets transferred to the Organizer; however, any manual entries in the 8858 Organizer will supersede the default filer data.
Enter the following information in Organizer:
  • FDE effective date, treaty information and principal business activity
  • Branch office or agent name and address
  • Custodian of books and records name and address
  • Tax owner information
  • Direct owner information
  • Organizational chart (FTC entities)
  • Filer information
  • FDE / FB general information
